# Inherited Property Transfer: Ownership After Probate (UK)

[By \- Samantha Graham,](https://propertyswift.co.uk/blog/author/samantha-graham) Nov 03, 2026

![ Featured Image](https://propertyswift.co.uk/hs-fs/hubfs/Probate%20Granted%20Property%20Transfer.png?width=1672&height=941&name=Probate%20Granted%20Property%20Transfer.png)

Yes. Once an inherited property is registered in your name, you can transfer it like any other owner. For example, you might add a spouse, gift it to your children or move it into joint names.

## Probate does not put your name on the register

A grant of probate (or letters of administration, if there is no will) gives the executor or administrator authority to deal with the estate. It does not change the title register by itself. To pass the property to you, the executor or administrator arranges a transfer or an assent and applies to HM Land Registry to update the register. Only then do you become the registered owner. That stage is their responsibility and is outside Property Swift's services.

Not every inheritance needs probate. For example, where the owners held the property as joint tenants, the survivor usually takes it without one.

An [official copy of the title register](https://propertyswift.co.uk/official-copy-of-the-title-register) shows the current registered owner.

## Registration, legal title and beneficial ownership

- **Legal title** is the right to deal with the property, such as signing a transfer.
- **Registration** is HM Land Registry's record of who holds the legal title.
- **Beneficial ownership** is the right to the property's value.

Usually one person has all three, but not always. Someone can be entitled to part of the value without being on the register, for example where the property is held on trust. The register does not always show this, although a restriction on the title can be a sign of it. If anyone else may have an interest, take legal advice before you transfer.

## If the property was jointly owned

When one registered owner dies, the legal title passes automatically to the surviving registered owners, whatever the will says.

The deceased owner's share of the value can go a different way:

- **Joint tenants:** the surviving owners take it automatically.
- **Tenants in common:** it passes under the deceased's will or the intestacy rules, possibly to someone else. The register often carries a restriction, and you should take legal advice.

Our guides to [joint to sole ownership](https://propertyswift.co.uk/blog/transfer-of-property-ownership-from-joint-to-single-a-complete-legal-guide-uk) and [tenants in common vs joint tenants](https://propertyswift.co.uk/blog/tenants-in-common-vs-joint-tenants-property-ownership-explained) explain more.

## Changing ownership after you have inherited

Common changes we see include:

- adding a spouse, civil partner or partner
- [putting the house in your children's names](https://propertyswift.co.uk/blog/putting-a-house-in-your-childrens-name)
- one registered co-owner giving their share to the other, with no money changing hands

**Example:** Daniel inherited his mother's mortgage-free terraced house in Leeds and is now its registered owner. He wants to add his wife, Priya. Nothing is being paid and the title has no restrictions, so this may qualify for Property Swift.

Transfers are most likely to be straightforward when the property is in England or Wales and mortgage-free, everyone agrees, the title has no restriction needing someone else's consent, and no money changes hands. Our services are not available where there is an existing mortgage, which usually needs the lender's consent and further legal work.

## Tax at a glance

Tax depends on your circumstances, so take independent tax advice before you transfer.

- **Stamp Duty Land Tax (SDLT).** Property you inherit under a will or the intestacy rules is not subject to SDLT. A later gift usually isn't either, unless the new owner pays you or takes on a mortgage. That applies between spouses too. In Wales, Land Transaction Tax applies instead. ([GOV.UK](https://www.gov.uk/sdlt-transferring-ownership-of-land-or-property))
- **Capital Gains Tax (CGT).** You are treated as acquiring the property at its value on the date of death. Gifts between spouses or civil partners who live together don't usually create CGT. A gift to anyone else is treated as made at market value. Where CGT is due on a UK residential property disposal, UK-resident individuals generally must report and pay it within 60 days of completion. ([HMRC](https://www.gov.uk/government/publications/death-personal-representatives-and-legatees-hs282-self-assessment-helpsheet/hs282-death-personal-representatives-and-legatees-2026))
- **Inheritance Tax (IHT).** Gifts to a spouse or civil partner are usually exempt. Since 6 April 2025, if you are a long-term UK resident and your spouse is not, the exemption is capped at the nil-rate band, currently £325,000, unless an election is made. ([HMRC](https://www.gov.uk/hmrc-internal-manuals/inheritance-tax-manual/ihtm47030)) Other gifts are generally free of IHT if you live for seven years after making them. However, if you gift a property but continue living in it, it may remain part of your estate for Inheritance Tax purposes. ([GOV.UK](https://www.gov.uk/inheritance-tax/gifts))

## A deed of variation is a separate matter

Within two years of a death, the beneficiaries can sometimes use a deed of variation to change who inherits. If the conditions are met, HMRC treats the change as if it were in the will. This is an estate-planning step that needs a solicitor's advice, and it is outside Property Swift's services.

## Other checks before you transfer

Before you transfer, check:

- the title register, for restrictions and any Inheritance Tax notice
- the lease, if the property is leasehold, as you may need to notify the landlord or get their certificate
- how the new owners will hold it (joint tenants or tenants in common), and whether you need a declaration of trust

Take independent legal advice if the estate is still being administered, the will is disputed, someone else inherited a share, or the title has a restriction you don't understand.

## How Property Swift can help

Property Swift provides administrative and document support for straightforward, mortgage-free property transfers in England and Wales. We are not a law firm, and we do not give legal or tax advice.

- **Self Service Property Transfer (£650).** We check eligibility, review the title register and prepare your HM Land Registry forms from the information you provide. Identity verification is arranged with a UK solicitor. You sign and submit the application yourself, and HM Land Registry fees are extra.
- **Solicitor Supported Property Transfer (£795).** An independent regulated conveyancer handles the relevant legal work, submits your application to HM Land Registry and deals with its queries. Standard registration fees are included, subject to our terms.

Neither service covers probate, mortgages or removing restrictions.

## Frequently asked questions

### Does probate put my name on the deeds?

No. Probate gives the executor authority to deal with the estate. To put your name on the register, the executor arranges a transfer or an assent and applies to HM Land Registry to update the register.

### Can Property Swift help if the inherited property has a mortgage?

No. Our transfer services are not available where the property has an existing mortgage. Speak to your lender and a conveyancer instead.

### Is there Stamp Duty if I add my spouse to an inherited property?

Not if it's a gift and your spouse takes on no mortgage. If they pay you, or take on a mortgage above the threshold, Stamp Duty Land Tax may be due.

### Which service should I choose?

Choose Self Service if you're comfortable signing and submitting the application yourself. Choose Solicitor Supported if you'd like a regulated conveyancer to submit it and handle HM Land Registry's queries. Our [Self Service vs Solicitor Supported](https://propertyswift.co.uk/blog/self-service-vs-solicitor-supported-property-transfer) guide compares them in more detail.
